Terms and Conditions

1. Operator of the Online Shop & Scope of Application
This online shop and the physical store under the name “Beetles & Bugs” are operated by:
Beetles & Bugs S.à r.l.
141 route de Trèves
L‑6940 Niederanven
Luxembourg
RCS Luxembourg: B287219
Authorisation No.: 10169469/0
VAT No.: LU35830580
These Terms and Conditions (“T&Cs”) apply to all purchase contracts concluded between Beetles & Bugs S.à r.l. (“we”, “the Seller”) and consumers within the meaning of applicable Luxembourg consumer law (“you”, “the Buyer”), whether purchases are made via our online shop or in our physical store.
By placing an order in the online shop or completing a purchase in the store, you expressly agree to these T&Cs. Without such acceptance, no purchase can be completed.
We sell exclusively to end consumers and only in customary household quantities.
2. Conclusion of Contract (Online Shop)
By clicking “Submit Order”, you submit a binding offer to purchase the items in your shopping cart.
The automated order confirmation you receive after placing your order merely confirms receipt of your order and does not constitute acceptance of your offer.
A binding purchase contract is only concluded when:
we have received your payment in full, and
we have dispatched the goods and confirmed shipment to you by a separate shipping confirmation email,
or when we expressly confirm acceptance of your offer by other means.
We expressly reserve the right to refuse or cancel an order prior to dispatch, in particular in cases of obvious errors, non‑availability of the goods or suspected misuse.
3. Payment & Dispatch Condition
The available payment methods are shown during the checkout process.
Goods will only be dispatched after full payment has been received and confirmed by Beetles & Bugs S.à r.l.
In the case of prepayment, payment must be received within 5 working days of order placement; otherwise, we reserve the right to cancel the order without further notice.
4. Availability & Delivery
Any delivery times indicated in the online shop are non‑binding estimates, unless a specific binding delivery date is expressly confirmed.
Delays in delivery do not entitle the Buyer to withdraw from the contract or to claim compensation, unless such rights arise from mandatory statutory consumer protection provisions.
Delivery is made to the delivery address specified by you within Luxembourg and to the other countries indicated in our online shop.
5. Prices & Taxes
All prices in the online shop are stated in euros (EUR) and include applicable Luxembourg VAT where required by law.
Shipping costs are borne by the Buyer and are displayed separately before you complete your order at checkout.
For deliveries outside the European Union, any customs duties, import taxes or other fees are borne entirely by the Buyer.
6. Retention of Title
Goods remain the property of Beetles & Bugs S.à r.l. until full payment of the purchase price and all associated costs and charges has been received.
7. Warranty & Liability
Statutory consumer warranty rights under applicable Luxembourg law apply.
Our liability is limited to intent and gross negligence, except where mandatory consumer protection law provides otherwise, including but not limited to liability for personal injury, product liability and other non‑excludable rights.
8. Right of Withdrawal (Online Purchases Only)
8.1 Statutory Right of Withdrawal
For purchases made via our online shop (distance contracts), you have the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period expires 14 calendar days from the day on which you or a third party named by you (other than the carrier) have taken physical possession of the goods.
8.2 Exercising the Right of Withdrawal
To exercise your right of withdrawal, you must inform us (Beetles & Bugs S.à r.l., address as above, email: insert email) by means of a clear statement (e.g. email or letter) of your decision to withdraw from this contract.
You may use the standard EU model withdrawal form, which we will provide upon request, but this is not mandatory.
The withdrawal period is met if you send your notice of withdrawal before the 14‑day period has expired.
8.3 Effects of Withdrawal
If you withdraw from this contract:
we will refund all payments we have received from you for the relevant order, including delivery costs corresponding to the least expensive standard delivery offered by us;
we will make the refund without undue delay and at the latest within 14 days from the day on which we receive your notice of withdrawal;
we will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise, and you will not incur any fees as a result of the refund.
We may withhold the refund until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.
8.4 Return Shipping Costs & Condition of Goods
You must send back or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you notified us of the withdrawal.
You bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
As far as reasonably possible, returned goods should be complete, undamaged, clean and, where feasible, in their original packaging with all tags attached. This is not a strict requirement for the valid exercise of your statutory right of withdrawal, but it facilitates processing.
9. Exclusions from Return & Exchange
9.1 Legal Exclusions from the Right of Withdrawal
The right of withdrawal does not apply in the cases provided for by law, for example:
sealed goods which are not suitable for return for health protection or hygiene reasons and which have been unsealed after delivery;
other specific exceptions laid down in applicable EU and Luxembourg law.
9.2 Online Purchases – Sale Items
The statutory right of withdrawal also applies to reduced or sale items purchased online. This right cannot be excluded.
10. In‑Store Purchases (Physical Store)
For purchases made in our physical store, no statutory right of withdrawal applies, as these are not distance contracts or contracts concluded away from business premises.
Without prejudice to any mandatory warranty rights in case of defective goods:
sale / outlet items purchased in‑store are excluded from exchange or return unless a legal defect exists;
any exchange of non‑faulty goods is purely voluntary (goodwill) and subject to the conditions set out below.
11. Exchanges & Store Credit (Voluntary)
11.1 Where we voluntarily accept an exchange (e.g. goodwill in our physical store), the following conditions apply unless otherwise communicated:
exchange is possible within 14 days of the purchase date;
the goods must be unused, undamaged, complete and returned with all original tags and the receipt.
11.2 Instead of a cash refund, we will issue a gift voucher / store credit. Cash refunds are excluded in such voluntary exchange cases.
12. Gift Cards
Gift cards are non‑refundable and cannot be exchanged for cash, except where required by mandatory law.
Gift cards can be used for purchases in our store and/or online shop as indicated on the card or in the accompanying information.
13. Customer Card / Loyalty Programme
13.1 General
We offer a voluntary customer card (loyalty programme) for our customers. Participation is open to consumers only and requires your registration and acceptance of these T&Cs as well as our separate privacy policy in line with the General Data Protection Regulation (GDPR).
13.2 Point Collection System
For every full euro you spend in our online shop or physical store, 1 point is credited to your customer account (1 EUR = 1 point).
Points are credited after completion and payment of the purchase.
Certain items, discounted products or purchases made using vouchers may be excluded from point collection; any such exclusions will be clearly communicated during the purchase process.
13.3 Redemption of Points
Points can be redeemed once you have accumulated at least 500 points (corresponding to purchases of 500 EUR).
For every full 500 points, you receive a 5 EUR discount on your purchase.
Redemption is possible at the in‑store checkout or during the online checkout process, as indicated there.
Points cannot be exchanged for cash and have no cash value, except where mandatory law stipulates otherwise.
Example:
500 points → 5 EUR discount
13.4 Validity, Changes & Termination
Points are personal, non‑transferable and can only be used by the registered customer.
We reserve the right to modify or discontinue the loyalty programme, taking into account the legitimate interests of participants and applicable consumer information and transparency requirements.
Any change that materially affects your already collected points will only take effect after reasonable prior notice, during which you may redeem your points under the previous conditions.
13.5 Data Protection
Personal data processed in connection with the customer card / loyalty programme is handled in accordance with the GDPR and applicable Luxembourg data protection law. Details are set out in our privacy policy available in store and in our online shop.
14. Intellectual Property
All content on this website and in our marketing materials (including, but not limited to, texts, images, logos and designs) is protected by copyright and other intellectual property rights.
Any use beyond what is necessary for the proper performance of a purchase (such as reproduction, distribution or public display) requires our prior written consent.
15. Applicable Law & Jurisdiction
These T&Cs and all purchase contracts between you and us are governed by the laws of Luxembourg, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Mandatory consumer protection rules of the country in which you have your habitual residence remain unaffected.
For all disputes arising from or in connection with these T&Cs, the courts of Luxembourg shall have jurisdiction, to the extent this is compatible with mandatory consumer jurisdiction rules.
16. Final Provisions
Should any provision of these T&Cs be or become invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the economic intent of the parties.
The current version of these T&Cs is available in our online shop and can be consulted in our store.
BY PLACING AN ORDER IN THE ONLINE SHOP OR COMPLETING A PURCHASE IN THE STORE, THE BUYER ACCEPTS THESE TERMS AND CONDITIONS.
